Data privacy statement according to the GDPR

This statement describes how Fattinger GmbH (hereinafter also referred to as "we") processes personal data.  Recipients of this statement are:

  • Existing customers - including management, employees and shareholders
  • Former customers - including management, employees and shareholders
  • Interested parties - including management, employees and shareholders
  • Future customers - including management, employees and shareholders
  • Website visitors

The protection of personal data is a major concern for us. We process data exclusively on the basis of legal provisions.

II. PROCESSING PURPOSES AND LEGAL BASIS

The processing of personal data is carried out for the following purposes:

  • Bookkeeping

The processing of personal data is based on the following legal grounds:

  • Article 6(1)(a) GDPR – Consent
  • Article 6(1)(b) GDPR – Performance of a contract/pre-contractual obligations
  • Article 6(1)(c) GDPR – Compliance with a legal obligation

If the processing is carried out in connection with marketing activities/public relations based on legitimate interests, it must be noted that the interest in carrying out marketing activities/public relations (e.g., operating a website) is, as a result of an interest balancing in the sense of a thriving business life (interest in business development and interest in intensifying business relationships), at least as high as any potentially existing interest in not being subject to the aforementioned data processing. Neither fundamental rights nor fundamental freedoms requiring the protection of personal data override the legitimate interest of us and our customers and possibly third parties.

The following categories of data are processed by us:

  • Personal identification data (salutation, first name, last name, address, date of birth etc.)
  • Public identification data (company etc.)
  • Contact data (email address, phone number, fax etc.)
  • Contract data (invoice number, contract date etc.)
  • Invoice data/Debt data (invoice, valuation, debt reason etc.) / Payment information
  • Enforcement data/Court data
  • Information from public directories and official announcements

We receive the personal data in the course of an order or through the disclosure of the data by the person themselves or based on a visit to the website.

In the course of our business activities, data may be transmitted to the following recipients:

V.DATA PROTECTION SPECIFICATIONS

Cookies /Provider

Our website does not use cookies.

Google Maps
We use an external link to the maps of the service "Google Maps" of the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, on our contact page. Before displaying Google Maps, we make you aware that Google Maps is opened. The processed data at Google may particularly include IP addresses and location data of users. The data can be processed in the USA. Data protection declaration: www.google.com/policies/privacy/, Opt-Out: adssettings.google.com/authenticated.

The operator of our web server is T-Mobile Austria GmbH (www.magenta.at) (hereinafter referred to as Provider). Access to the website and the database is logged by the Provider in log files. The data protection provisions of the Provider apply in this context within the framework of an agreement on data processing in accordance with Article 28 GDPR. The server location is Austria.

 

VI. DURATION OF STORAGE

Data is stored for the duration of the legal retention obligations according to § 132 BAO or § 212 UGB for 7 years, unless other legal requirements dictate a longer storage period.

Generally, data is retained for the duration of the contractual relationship/business relationship with our customers and after its termination at least for as long as legal retention periods apply (see above) or the limitation periods for potential legal claims have not yet expired.

Data from interested parties is stored for as long as there is a possible interest in cooperation. If such interest does not exist (e.g., through a clear declaration of intent), the data is deleted immediately. At most, we retain data of interested parties for 2 years. These explanations apply accordingly to contact via website or email.

 

VII. RIGHTS OF THE DATA SUBJECT

The following rights apply under the conditions set forth in the legal provisions (Articles 15 to 22 GDPR):

  • Right to information
  • Right to rectification
  • Right to erasure
  • Right to restriction of processing
  • Right to data portability
  • Right to object (if processing is based on Article 6(1)(e) or (f) GDPR)

Consents can be withdrawn at any time from the respective contractual partner.

 

VIII. RIGHT OF COMPLAINT TO THE SUPERVISING AUTHORITY
